For a nominal fee, the Travis County Clerk’s Probate Division will hold an original copy of your will for safekeeping. You may want to discuss this with your attorney or refer to the Texas Estates Code, Chapter 252, for more information.

If you possess the will of a deceased person, by law you must file it with the Clerk’s Probate Division. Section 252.201 of the Texas Estates Code states: “On receiving notice of a testator’s death, the person who has custody of the testator’s will shall deliver the will to the clerk of the court that has jurisdiction of the testator’s estate.” There is no filing fee for this service.
