One Step Closer to Marriage Equality
Austin, TX – This afternoon, February 26th, San Antonio Judge Orlando Garcia issued a ruling that declares Texas laws limiting marriage to one man, one woman are unconstitutional. Judge Garcia said in his opinion, “Equal treatment of all individuals under the law is not merely an aspiration — it is a constitutional mandate.”
The ruling also included a stay which prevents further action until the case completes the appeals process before the Fifth Circuit Court of Appeals. “Because of the stay order in the ruling, the County Clerk cannot issue marriage licenses to gay couples at this time,” said County Clerk Dana DeBeauvoir. “This is a joyous day, but we will have to wait a little longer to actually deliver the justice and equal rights gay couples so deserve,” DeBeauvoir said.
